Incidental Outbuildings and the Preston Hills Home Owners Association 


There has been some confusion about "incidental outbuildings" (sheds) in the neighborhood. As you drive around Preston Hills Sections 1, 2, and 3, you will see some with brick veneer and some without. We would like to explain how this has happened. 

Section 1 homeowners are outside the jurisdiction of the Preston Hills Homeowners Association (PHHOA). An easy way to distinguish between the sections is homes in section 1 do not have sidewalks and the other sections do. 

Sections 2 and 3 Homeowners have regulations about "incidental outbuildings" (sheds). The "Owner's Restrictions and Protective Covenants" state that any such buildings shall be brick veneer, with the same brick as the main building, at the option of the building committee, and shall be approved as to design and location by the building committee. 

The developer, however, did not enforce any regulations. When the Preston Hills Homeowners Association was given responsibility for sections 2 and 3 on April 1, 2000, there was one shed in section 2 without matching brick veneer. Since the Board (and building committee) had no access to any prior shed plans or approvals, they had no choice but to "grandfather in" the shed prior to the Association's existence. Any "incidental outbuildings" (sheds) constructed after April 1, 2000 must be in accordance with the "Owners Restrictions and Protective Covenants" of sections 2 and 3.
